School Budget Cap Ballot Question is on the Ballot!

On September 16th, Merrimack County Superior Court Judge Daniel St. Hilaire dismissed a lawsuit that argued against the ballot question to impose school budget caps across the state (an emergency appeal to the NH Supreme Court was also denied the following day). Although New Hampshire is not a referendum state, this back-door attempt to unconstitutionally circumvent legislative and electoral process comes after almost all school districts who had budget cap proposals on their warrants this spring and last year saw them defeated. In response, Majority Leader Jason Osborne told the NH Journal, “Perhaps, if [local voters] are unwilling to cap themselves, the state will step in and cap local taxes for them.” Which is exactly what this ballot question will do.

In light of this decision, we encourage you to read this Perspectives piece from August 23rd by Representative Eileen Kelly that forcefully makes the case this ballot question is unconstitutional, in addition to being deceptive and confusing. Please read it again, and use these arguments to inform your family, friends, and neighbors about this latest attempt by the NH GOP/Free State agenda to take away local control and defund our public schools!
